Yuichiro Tamaki, Leader of Japan’s Democratic Party For the People (DPFP), Mentions Hyperliquid in Regulatory Debate; Discussions with bitFlyer CEO Focus on DEX Oversight

国民民主党の玉木代表がハイパーリキッド(Hyperliquid)に言及。BitFlyer加納CEOとDEX規制巡り議論
A public discourse on the regulatory framework for Decentralized Exchanges (DEXs) has rapidly intensified in Japan. This movement was catalyzed by a post on X (formerly Twitter) on April 15, 2026, by Yuichiro Tamaki, leader of Japan’s Democratic Party for the People (DPFP). Mr. Tamaki highlighted the explosive growth of Hyperliquid—a protocol that generated $900 million in annual profit with only 11 employees within three years of inception—citing it as a prime example of the transformative potential of on-chain finance. ## Key Points of the Debate: Policy vs. Compliance The following day, Yuzo Kano, CEO of bitFlyer, provided a counter-perspective. He noted that Japanese licensed crypto-asset exchangers are currently prohibited from operating DEXs. Mr. Kano argued that Hyperliquid’s utility is largely derived from its "non-compliance with existing laws," specifically regarding the absence of Know Your Customer (KYC) and Anti-Money Laundering (AML) protocols. He emphasized that if such operations were legalized and regulated, domestic firms would immediately enter the DEX development space. In response, Mr. Tamaki acknowledged that while current Japanese regulations are strictly designed for investor protection, a "regulatory vacuum" exists regarding DEXs. He argued for establishing rules to integrate these businesses domestically. Mr. Kano countered that the crux of the issue lies in the current structure, where only offshore entities effectively serve Japanese residents. He proposed a policy choice: either (1) deregulate DEX businesses for domestic firms or (2) strictly enforce regulations on offshore providers. ## Global Context: U.S. Regulatory Pivot This domestic debate is unfolding against a shifting global landscape. Following the inauguration of the Trump administration, the SEC dropped its investigation into Uniswap Labs in February 2025. By April 2026, the SEC's Division of Trading and Markets indicated that DeFi frontend providers might not be subject to broker-dealer registration under certain conditions. Meanwhile, Hyperliquid has captured over 60% of the DEX derivatives market, processing $1.59 trillion in cumulative volume (Aug 2025 – Jan 2026), making it the only DEX among the world's top 10 trading platforms. ## Business Development Insights ## 1. Addressing "Cross-Border Regulatory Gaps" and Industrial Hollowing The core risk is not technological but industrial. As noted by Mr. Kano, the high-performance DEXs currently used by Japanese residents are offshore entities, leading to the outflow of fees, tax revenue, talent, and data. - Strategic Implication: Lobbying efforts toward the Financial Services Agency (FSA) and Ministry of Economy, Trade and Industry (METI) are expected to intensify. Discussions regarding a new "DEX-Specific Exchange License" may enter the policy agenda. Domestic financial institutions should begin R&D on DEX products now to secure a "first-mover advantage" upon deregulation. ## ## 2. The Rise of "KYC/AML-Integrated DEXs" The winning strategy for domestic players lies in "Regulation-Aligned DEXs" that incorporate compliance within the technology stack. This aligns with global trends like Stripe/Paradigm’s Tempo Zones and permissioned DEXs on the XRP Ledger. - Strategic Implication: This creates opportunities for "Privacy-Preserving Compliance" using Zero-Knowledge Proofs (ZKP) or "Proof of Human" technologies like World ID. A realistic pilot would involve a compliant DEX within a regulatory sandbox, utilizing domestic stablecoins (e.g., JPYC, DCJPY) as base pairs. ## ## 3. Transparent Dialogue as a Turning Point in Policy Formation The public interaction between a party leader and a prominent CEO marks a shift from closed-door committee meetings to open, social-media-driven policy debate. - Strategic Implication: With the 2026 Upper House elections approaching, Web3 policy may become a point of differentiation for political parties. Investment in "Policy Engagement" (participation in industry associations like JCBA or JVCEA) will yield higher ROI. For Japanese firms, cross-industry alliances—combining stablecoin issuers, exchangers, and L1 providers—will be essential to forming a "Japan-Originated Global DEX" consortium.
